1. Acceptance of Terms

By downloading, installing, or using the SeniorNest mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users of SeniorNest, including account holders (subscribers) and family members who join a nest.

2. Description of Service

SeniorNest is a family connection app designed to help seniors and their loved ones stay connected. The App allows users to:

• Send and receive messages, photos, voice recordings, and videos within a private family nest.
• Share wellness check-ins ("I'm Good" notifications).
• Save and organize cherished memories and favorite messages.
• Store emergency contact information.

3. Accounts and Registration

To use SeniorNest, you must create an account using a valid email address or through Apple Sign-In or Google Sign-In. You are responsible for:

• Providing accurate and current account information.
• Maintaining the confidentiality of your account credentials.
• All activity that occurs under your account.

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this age requirement.

4. Subscriptions and Billing

SeniorNest operates on a subscription model. One family member (the account holder) purchases a subscription, and all other family members may join and use the App for free.

• Subscriptions are billed through the Apple App Store on a recurring basis (monthly or annually, depending on the plan selected).
• Subscription fees are charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription in your Apple ID account settings at any time.
• No refunds are provided for partial subscription periods, except as required by applicable law.

5. User Content

You retain ownership of all content you create and share within SeniorNest, including messages, photos, voice recordings, videos, and memories ("User Content").

By using SeniorNest, you grant us a limited license to store, display, and transmit your User Content solely for the purpose of providing the service to you and your family members.

You agree not to post or share content that:

• Is unlawful, harmful, threatening, abusive, or harassing.
• Infringes on the intellectual property rights of others.
• Contains viruses or malicious code.
• Violates the privacy of any third party.

6. Acceptable Use

You agree to use SeniorNest only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that could damage, disable, or impair the service.
• Attempt to gain unauthorized access to any part of the App or its related systems.
• Use the App to transmit unsolicited communications or spam.
• Misrepresent your identity or affiliation with any person or organization.

7. Privacy

Your use of SeniorNest is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding your personal information.

8. Termination

You may terminate your account at any time by contacting us at support@seniornestapp.com. Upon termination, your right to use the App will immediately cease.

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that we determine is harmful to other users or the service.

9. Disclaimers

SeniorNest is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.

SeniorNest is not a medical device or emergency service. The emergency contact feature is provided as a convenience only and should not be relied upon in place of calling emergency services (911).

10. Limitation of Liability

To the fullest extent permitted by applicable law, SeniorNest and its owners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of SeniorNest after changes are posted constitutes your acceptance of the updated Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
